Education (Extension of Benefits) Act (Northern Ireland) 1950

1950 CHAPTER 20

An Act to extend certain benefits which, under the Education Act (Northern Ireland) 1947, may be provided for pupils undergoing further education; to make provision for the grant of certain scholarships under section seventy-six of that Act without regard to the means of the parents of pupils concerned; and for purposes connected with those matters. [25th July, 1950].

BE it enacted by the King's most Excellent Majesty, and the Senate and the House of Commons of Northern Ireland in this present Parliament assembled, and by the authority of the same, as follows:-

1 Amendments of 1947 c. 3

(1) The Education Act (Northern Ireland) 1947 (in this Act referred to as "the principal Act") shall have effect subject to the provisions of this section.

(2) At the end of section forty-three of the principal Act (which relates to the provision of milk and meals) there shall be added the following words:-

"Regulations made under this section shall empower local education authorities to provide, in

accordance with arrangements approved by the Ministry, milk, meals and other refreshment for pupils (being pupils who have not attained the age of eighteen years) in attendance at full-time day courses in institutions providing further education.

For the purposes of this section and of section fifty-seven A of this Act a pupil shall be deemed not to have attained the age of eighteen years until the thirty-first day of July next succeeding the date upon which he attained that age."

(3) After section fifty-seven of the principal Act there shall be inserted the following section:-
57A Power of exemption from fees in respect of further education

(1) A local education authority may exempt any pupil who has not attained the age of eighteen years (as defined in section forty-three of this Act) from payment of fees in respect of his attendance at any full-time day course in any institution providing further education.

(2) The provisions sub-sections (2) and (3) of the last preceding section shall have effect for the purposes of this section as they have effect for the purposes of that section."

(4) For sub-section (1) of section seventy-six of the principal Act (which relates to the provision of scholarships by local education authorities) there shall be substituted the following sub-section:-

"(1) It shall be the duty of local education authorities, subject to and in accordance with regulations made by the Ministry, to grant scholarships and special allowances to or in respect of pupils attending or intending to attend grammar schools who comply with the prescribed conditions; and such conditions may, without prejudice to their generality, include conditions providing for the grant of such special allowances for the purpose only of the avoidance or alleviation of hardship to the pupils concerned or their parents.".

2 Expenses

Any increase attributable to the provisions of this Act in the expenses to be defrayed out of moneys provided by Parliament under section one hundred and eight of the principal Act shall be defrayed out of moneys so provided.

3 Interpretation

Any reference in this Act to any provision of the principal Act shall, unless the context otherwise requires, be construed as a reference to that provision as amended or extended by or under any other enactment, including this Act.

4 Short title, construction, citation and commencement

(1) This Act may be cited as the Education (Extension of Benefits) Act (Northern Ireland) 1950.

(2) This Act shall be construed as one with the Education Acts (Northern Ireland) 1947 and 1950, and those Acts and this Act may be cited together as the Education Acts (Northern Ireland) 1947 to 1950.

(3) This Act shall come into operation on the first day of August, nineteen hundred and fifty.
